1. Acceptance of Terms

By accessing or using Emo9™ ("we", "our", "us"), you agree to be bound by these Terms & Conditions. If you do not agree, you must not use the application.

2. Description of Service

Emo9™ is a communication platform that enables users to exchange messages using interactive features such as facial expression-based unlocking, voice input, and moment-based interactions.

Some features may require access to your device camera, microphone, or other permissions to function properly.

3. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use Emo9. By using the service, you confirm that you meet this requirement.

4. User Responsibilities

You agree to use Emo9 responsibly and not to:

Use the platform for unlawful, harmful, or abusive purposes
Harass, threaten, or violate the rights of others
Upload or share illegal, harmful, or inappropriate content
Attempt to interfere with or misuse app features or systems

5. Feature Usage & Permissions

Certain features of Emo9 use your device camera, microphone, or other inputs to enable functionality such as message unlocking and interactive communication.

These features operate only after you grant permission and are used solely for the intended in-app functionality.

6. Recording & User Awareness

Some features, such as moment-based interactions, may involve recording audio or video when you choose to interact with those features.

Recording occurs only as part of user-initiated actions within the app and is visible during use. Emo9 does not perform hidden or background recording.

You are responsible for obtaining consent from other individuals if you record or share their voice, image, or content.

7. User-Generated Content

You retain ownership of the content you create and share on Emo9.

By using the service, you grant us a limited, non-exclusive license to process and display your content solely for providing app functionality.

You are solely responsible for your content and any consequences resulting from its use or sharing.

8. Emo9 Studio Feature

Emo9 Studio allows photographers, event hosts, and guests to create and participate in interactive event memory experiences.

Through Emo9 Studio, users can join events, receive personalized event photos, access event memories, and interact with features such as Event Memory Wall and guest video wishes.

Event Participation: Guests may join events using QR codes, invite links, or other access methods shared by photographers or event organizers.
Photo Matching: Certain Studio features may use face-based matching to help deliver personalized event memories to users who choose to participate.
User Consent: By participating in an event, you acknowledge that photos and event-related content may be processed and displayed within the Emo9 Studio experience.
Event Memory Wall: Guests may share short video wishes or memories within participating events. Users are responsible for the content they upload or share.
Google Drive Imports: Emo9 Studio currently supports importing event photos through publicly accessible Google Drive links shared by photographers or event organizers.
No Permanent Photo Storage: Emo9 Studio is designed to help users access and receive event memories directly from shared Google Drive content. Event photos are not intended to be permanently stored on Emo9 servers.
Public Link Access: By importing photos using a public Google Drive link, photographers and event organizers acknowledge that the selected content is accessible for processing within the Emo9 Studio experience.
Photographer Responsibility: Photographers and event organizers are responsible for ensuring they have the appropriate rights, permissions, and sharing settings for any content imported into Emo9 Studio.

9. Emo9 Lens Feature

Emo9 Lens is a feature that allows users to capture, share, and receive photos with connected users based on mutual consent and feature activation.

Connection Requirement: Photo sharing through Emo9 Lens is only enabled after both users explicitly accept a connection request within the app.
User Responsibility: You are responsible for ensuring that you have the necessary consent from individuals before capturing or sharing their images through the Emo9 Lens feature.
Automatic Sharing: Depending on user settings, photos captured using Emo9 Lens may be automatically shared with connected users if they are detected in the image.
Control Over Sharing: Users can enable or disable automatic sharing at any time. You are responsible for reviewing your sharing settings.
Content Responsibility: You are solely responsible for any photos you capture, upload, or share using Emo9 Lens and any consequences arising from such sharing.
Misuse: You agree not to use Emo9 Lens to capture, store, or share content that is unlawful, invasive of privacy, or harmful to others.

10. Third-Party Services

Emo9 may integrate with third-party services. We are not responsible for their content, policies, or practices.

11. Privacy

Your use of Emo9 is also governed by our Privacy Policy, which explains how your data is collected and used.

12. Account Suspension & Termination

We reserve the right to suspend or terminate your access if you violate these Terms or misuse the platform.

13. Limitation of Liability

To the maximum extent permitted by law, Prixporte Software Private Limited ("Emo9™") shall not be liable for indirect, incidental, or consequential damages arising from your use of the service.

14. Disclaimer of Warranties

Emo9 is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted or error-free operation.

15. Changes to Terms

We may update these Terms from time to time. Continued use of the app after changes means you accept the updated Terms.

16. Governing Law

These Terms shall be governed by applicable laws in your jurisdiction.

17. Trademark

Emo9™ is a trademark of Prixporte Software Private Limited. All rights in the Emo9 name, logo, and associated branding are reserved.

You may not use, copy, reproduce, or distribute the Emo9 brand, logo, or identity without prior written permission.
